Forensic Services

Neuropsychologists are in the unique position of being able to contribute to the assessment of individuals with neurologic conditions involved in criminal adjudication or civil legal matters. These individuals may have cognitive and psychiatric impairments that can impact judgment, understanding, insight, adaptability, and functional capacities relevant to issues in litigation. Forensic questions addressed by our services include cognitive impairments in the context of:

  • Competency in Criminal Matters (e.g., to be executed)
  • Competency in Civil Matters (e.g., to execute or change a will or medical directives)
  • Capital and Noncapital Mitigating Factors
  • Malingering and Deception

Initial evaluations and opinions are provided in the following areas:

  • Worker's Compensation
  • Disability/Social Security determination
  • Independent Medical (Psychological/Neuropsychological) Evaluation (IME)
  • Academic and work accommodations under the Americans with Disabilities Act (ADA)

Attorney Case Consultation

We are available to assist attorneys with cases involving mental health issues. Services include but are not limited to:

  • Reviewing documents to identify mental health issues that warrant further investigation
  • Reviewing documents to identify standard of care concerns that warrant further investigation
  • Reviewing and critiquing an expert’s report for the purpose of developing questions for deposition, direct examination, and/or cross examination.
  • Assessing the merits of a mental health defense
  • Developing appropriate referral questions to be addressed by a retained expert
  • Explaining psychological test findings and psychiatric diagnoses
  • Examining the relevant empirical and professional literature concerning a psycholegal issue or an expert’s testimony
